New provincial legislation announced in 2023, including the Housing Statutes Amendment Act and the Short-Term Rental Accommodations Act brought sweeping changes to local land use regulation which may create lasting effects on small business owners operating short term rental accommodation businesses. Under this legislation, Short Term Rental operators are required to register their businesses with the Province, and may no longer enjoy lawful non-conformance status where their business is inconsistent with the applicable zoning bylaw.
To support local businesses who now must chart a path forward under the new regulations, the NCRD has modified its policies for Temporary Use Permits in Electoral Areas D (Rural Graham Island) and E (Sandspit) to reduce the administrative burden and costs associated with bringing their businesses into compliance with the zoning bylaw.
Quick Facts
- Temporary Use Permits offer a short-term (3 years or under) method of supporting business owners to have the time to determine their preferred route to compliance under new regulations.
- The NCRD has reduced all planning application fees, and temporarily waived Temporary Use Permit fees until October 17, 2026 to support the affordability of compliance and operation of short-term rental accommodation businesses in the interim.
